Abstract

L’interprétation constitutionnelle judiciaire au Canada est le moteur principal dans le développement du corpus constitutionnel en parallèle avec l’évolution de notre société. En plus des amendements constitutionnels législatifs, l’interprétation judiciaire est maintenant l’un des principaux forums de l’enrichissement constitutionnel. Ce mémoire explore la légitimité, les avantages et les conséquences de l’ajout et la modification des normes constitutionnelles par le biais de décisions judiciaires, ce que nous nommons la « constitutionnalisation ». Nous explorons ce concept en conjonction avec le potentiel des tribunaux de jouer un rôle plus important dans la mise en œuvre des droits et libertés constitutionnels, ce que nous nommons l’« opérationnalisation ». Judicial constitutional interpretation in Canada is the main driver in the development of the constitutional corpus in parallel with the evolution of our society. In addition to the legislative amendment of the constitution, judicial interpretation is now one of the main forums for constitutional change. This text explores the legitimacy, benefits, and consequences of the practice of adding or modifying constitutional norms through judicial decisions, what we call “constitutionalisation”. We explore this concept in conjunction with the judiciary’s potential to play a greater role in implementing constitutional rights and freedoms, what we call “operationalization”.
